Covenant, Condition, Restrictions

 
Dear Owners,
               
Recently our community declarations (governing rules) were amended and refiled with the Superior Clerk of Cobb County. One of the major changes was prohibiting the leasing of lots in the Misty Glen subdivision. The HOA board understood there were lots already leased at the time of rewrite. Therefore, the amended declarations allow a total of 25% of the 177 homes to be leased. However, the homes under lease are required to provide a current lease and tenant information to the board within 30 days after the court filing to be considered a Grandfathered lot. Afterwards, the leased lots are to apply for a leasing permit to be in compliance.
 
 
Furthermore, ALL LOT owners are REQUIRED to provide an affidavit stating the OCCUPANCY status of your property so that, the Board may govern the community accordingly.
 
 
"Failure to submit the occupancy affidavit will result in the Presumption of leasing by the Unit Owner and will result in the issuance of the LEASE ADMINISTRATION FINE."
                                                                                     
    
We all agreed to the Covenant, Conditions, and Restrictions that governs MISTY GLEN when we purchased our lots. Please take the time to read the complete declarations online. We are here to assist all homeowners in our community. Do not hesitate to reach out to the Board if you have questions.
